Abstract


RULE OF LAW AND THE RULE OF LAW IN DEVELOPMENT PROCESS OF TURKEY

Since the rule of law came into our lives at the end of the 18th century, it rapidly replaced the previous understanding of the property state and police state and began to enter the constitution of countries. Although it limits the duties and powers of the ruling class, it stands out as a principle that draws attention because it guarantees the fundamental rights and freedoms of citizens within the state. In Turkey, for the first time with the 1961 Constitution, the rule of law in our lives has been the dominant factor in all kinds of constitutional decisions and from this date, the Supreme Court has made a name frequently in the decision. In this study, after explaining the meaning of the rule of law and then examining the stages of entry into the Turkish constitution, how it affects the decisions of the Constitutional Court will be discussed
