The Franchise Agreement is a compiled agreement in essence and one that was put together outside the Turkish legislation. In the description of the agreement is made in various ways in the doctrine. multiple elements are found within the Franchise Agreement, some of which are drawn from regulations. The increasingly popular franchise system is based on franchise agreements.
As the limitations in international trade are lifted, it is possible to come across franchise agreements that are comprised of foreign elements. These international franchise agreements manifest themselves in almost every business sector, occupying an important role in trade.
In this study, the issue of determining the competent court in franchise agreements with foreign elements will be investigated. In this context, first of all, the international jurisdiction of Turkish courts will be evaluated in terms of place of performance. Then, opinions will be given on the authorization agreements and the weak position of the franchisee.
